Just a quick reminder of your new responsibilities as a private landlord in England under the new electrical safety regulations that came into force this month.
- Ensure electrical safety standards are met when the property is occupied
- Every installation in the property is tested by a qualified person
- Testing must be at intervals of no more than 5 years
- Or the frequency specified in the inspection report
- Ensure you obtain a copy of the inspection report
- Provide a copy of the report to the person carrying out the next inspection
- Issue a copy of the report to existing tenants within 28 days
- Issue a copy of the report to new tenants before the start of the tenancy
- Have the report available on request to any prospective tenant
- Send a copy of the report to the housing authority within 7 days when requested to do so
- Issue a copy of an unsatisfactory report and written confirmation of remedial works to the local housing authority within 28 days of completion of the remedial work
Remember, where a local housing authority is satisfied, beyond reasonable doubt, that a private landlord has breached a duty under regulation 3, the authority may impose a financial penalty in respect of the breach. A financial penalty must not exceed £30,000.
