For these reasons, we place a high priority on the security of information we hold. We have developed this policy to inform you about how we manage your personal information and maintain its integrity and security in accordance with the Australian Privacy Principles and relevant industry privacy codes.

Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. You agree that these Terms of Use are supported by reasonable and valuable consideration, the receipt and adequacy of which you hereby acknowledge, including, without limitation, your access to and use of the Website and data, materials and information available at or through the Website.

Customers Privacy

We may use Data to customize and improve your user experience on this site. However, we will make efforts so that your Data will not be given to third parties, unless (i) we obtain your consent, such as when you chose to opt-in or opt-out to the sharing of Data; (ii) a service provided on our site requires the interaction with, for example, an Application Service Provider, (iii) pursuant to legal process of law enforcement.

As mentioned above, we may make videos, take photographs or make audio recordings of our events, services and products which may include your image or voice. You consent to being included in those videos, photographs and audio recordings.

Your personal information may be disclosed, transferred, stored, processed or used in the United States of America (USA), Singapore, United Kingdom (UK), Australia, New Zealand, Indonesia, Europe, Philippines and Malaysia by us or by our third party service providers. This may happen when you use our website, when we outsource certain activities overseas or if transactions, information, services or products have an overseas connection. You consent to the collection, use, storage, and processing of your personal information in an overseas country.

You have a right under the Privacy Act 1988 (Cth) (Privacy Act) to request access and seek correction to your personal information. You may do so by contacting us using the contact details above. In ordinary circumstances we will give you full access to your personal information. However, there may be some legal or administrative reasons to deny access. If access is denied, we will provide you with the reason why.

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

  • To provide the Service on our behalf
  • To perform Service-related services
  • To assist us in analyzing how our Service is used.

If other organisations provide support services, we require them to appropriately safeguard the privacy of the information provided to them.

Where the personal information we collect is no longer required, we delete the information or permanently de-identify it.

This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Payment Policy

An Acknowledgement receipt and details of order for the payment made, will be sent to your email address as proof of payment, within 3 working days. Additional copies of invoices or further details on transactions made can be obtained by contacting our accounts team at accounts@geniusu.com.

Online Ticket Purchase

Purchasers of tickets who are under eighteen (18) years of age should seek parental consent before purchasing tickets/ merchandises from our website. By transacting on our website, purchaser certifies that purchaser is at least (18) eighteen years of age & understands the conditions of use.

Payment Terms and Default of Payment

GeniusU Limited payment terms are 14 Days unless otherwise agreed by GeniusU in its sole discretion. Any amount not paid by the due date will incur interest at a rate of 10% calculated daily and compounded monthly.

In the event of any default in payment for Events and Programs GeniusU Limited reserves the right to suspend or terminate supply to the client and list customer with a credit reporting agency.

In the event of any default in payment for Licence fees due on a recurring basis for the Flow and Performance Consultant Licence the service will be terminated immediately and the Licence cancelled. If required issued and not yet paid tokens will be revoked/cancelled. GeniusU Limited reserves the right to suspend or terminate supply to the client and list customer with a credit reporting agency.

Default interest pursuant to clause 2 shall be payable on demand and calculated daily from the date the payment was due to the actual date that the payment is made in full.

Any payment the client makes to GeniusU shall first be credited against any default interest accrued pursuant to this clause 2 to the actual date of payment.

Rescheduling your enrolment

If you find that you are unable to attend the course on the dates for which you have enrolled, you may transfer your enrolment to another program or event provided you meet the below criteria; any re-scheduling will occur a USD$800 re-scheduling fee. Re-scheduling is only allowed when changes undertaken fall within one year from the date of initial registration. However, you agree that we may not convene the same or similar course again and that there is no obligation on us to do so. There may also be a price increase for the re-scheduled program or event and you agree to pay any increase in addition to the USD$800 re-scheduling fee if a price increase is relevant.

It is not possible to reschedule in any instance within 90 days prior to a program’s scheduled commencement date.

If you do not reschedule within 1 year of initial registration as per the conditions stipulated above you will forfeit the money you paid to attend and you will have no other claim against us to attend any program/event or alternative program/event or for a refund or compensation.

Transferring tickets

In the event that you cannot attend to receive the Event/course for which you booked, your ticket is transferable to another person, provided that you identify to us the person to whom you wish to transfer your ticket together with full contact details for your substitute, at least seven (07) days before the Event/course. Once the transfer has taken place the transferee will be bound by the same terms & conditions as the original ticket holder. Any funds due or outstanding will remain due from the initial attendee that agreed to these Terms and Conditions at the point of sale.

Enrolment Deposit & Payments for Enrolments

We will not deem you to be enrolled until we receive a part or full payment for the event or program from you. You must pay any remaining balance on your enrolment at least thirty (30) days prior to commencement of the program. We may offer services such as payment plans however use of such facilities is optional and does not override the requirement that your enrolment must be fully paid thirty (30) days prior to the commencement of the program start date unless a pre agreed payment plan is in place such as for monthly memberships or licenses or pre agreed payment plans for One year Mentoring programs.

Event/Course changes

We may for any reason deem it necessary to change the Event/course dates, audience capacity, venue, speaker or hours without prior notice. In such circumstances, you retain the right to reschedule your enrolment in accordance with our rescheduling policy clause.

Should you receive a gifted place from a GeniusU or Entrepreneur Resorts for one of our programs, which are listed here but are not limited to: Wealth Dynamics Masters in Bali or Tau / Investor Dynamics Masters at Tau/ Crystal Circle Mentoring / Flow Consultant Certification / Performance Consultant Certification or iLAB, the gifted place cannot be gifted or transferred to another person in lieu of payment. The Program Manager can authorise a substitution one month prior to the start date of the event/program and this is required to be in writing over email.

Event cancellation

If for any reason we deem it necessary to do so, we may cancel any Event/course by notifying you in writing, in which case, we will refund the total amount you have paid for your enrolment. This is your sole right and remedy against us and you will have no other claim against us for a refund or for compensation.

Refunds

No refund can be made for cancellations or no-show at an event or program upon successful registrations. No refund can be made on any of the courses and mentoring programs organised by Wealth Dynamics, Entrepreneur Institute, Entrepreneur Resorts Ltd, The Genius Group or its partners. However, substitutions will be welcomed if you are unable to attend.

Refund Policy

For shipped products, you may return most new, unopened items within 30 days of delivery for a full refund. We’ll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.).

You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

If you need to return an item, simply login to your account, view the order using the “Complete Orders” link under the My Account menu and click the Return Item(s) button. We’ll notify you via e-mail of your refund once we’ve received and processed the returned item.

Shipping

We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.

When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.

Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

Limitation of Liability

GeniusU Limited and any of its associated companies do not accept liability for accident, injury or loss suffered while attending the Event/course including those run or hosted by our representatives, subsidiaries or event partners including City Circle Leaders.

ONLINE AFFILIATES TERMS AND CONDITIONS

By signing up as an affiliate with GeniusU Limited, you agree to the following Terms of Service. This agreement is by and between GeniusU Limited and/or their assigns and all subscribers including but not limited to Wealth Dynamics Pte Ltd (Entrepreneurs Institute) Entrepreneur Resorts Pte Ltd or any of their Subsidiary companies or businesses. Unless the context requires otherwise, GeniusU Limited and/or their assigns shall be referred to as “us, we, or our” and you shall be referred to as “you, your or subscriber.”

You understand that GeniusU Limited and/or their assigns does not guarantee or predict any type of profit or response from said services. Subscriber agrees to hold GeniusU Limited harmless from and against any and all losses, claims, expenses, suits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature which GeniusU Limited and/or their assigns may become subject arising out of or relating in any way to the use of the services provided under this agreement, including, without limitation, in each case attorneys’ fees, costs and expenses actually incurred in defending against or enforcing any such losses, claims, expenses, suits, damages or liabilities.

GeniusU Limited reserves the right not to accept affiliate applications at our sole discretion, and without obligation to divulge cause. Should an application not be accepted, any url’s (uniform resource locators) and/or marketing resources already provided to the applicant will have any further access withdrawn.

Services to be Provided

We agree to pay you certain commissions as described on our website for referral sales made by customers. In order for you to receive payment of commissions it is essential that referral purchases be made online after having gained access via your unique affiliate code. You will not be eligible for any commission for sales made through GeniusU Limited’s call centre, regardless of whether the referral came through you.

Commission

Should any client have an outstanding balance with no confirmed payment plan in place then any commission due and payable will be allocated (offset/credited) to the oldest outstanding account. This offset will be applicable to any associated affiliate (commission earning) entity held by the debtor. This is applicable to any of the entities of the Genius Group.

Monthly Flow & Performance Consultant

Flow Consultant & Performance Consultant License Fees

The licence fee is applicable for a 12-month period. The fee can be paid upfront as $1500 USD for 12 months or alternatively $150 USD per month for 12 months. The licence is renewable on an annual basis. Cancellation is only applicable after a 12-month cycle and we would require a 28-day notification of this. If no notification is received, the license will automatically renew as to keep a continuation in benefits. This will renew on a month to month basis from year 2 onwards.

All licensed Flow Consultant and Performance Consultants are required to be at mentor status on GeniusU. If as a mentor, you have upgraded to a licensed Flow or Performance Consultant at the special mentor rate, you will also be required to continue your Genius Entrepreneur Mastermind payment to retain your mentor status.

In the event of any default in payment for Licence fees, due on a recurring basis for the Flow Consultant Licence, the service will be terminated immediately, the Licence will be cancelled and you will be liable for the full outstanding amount for the balance of the 12 month period. If required, issued and not yet paid tokens will be revoked/cancelled. GeniusU Limited reserves the right to suspend or terminate supply to the client and list customers with a credit reporting agency.

Genius Entrepreneur Mastermind Membership Fees

The licence fee is applicable for a 12-month period. The fee can be paid upfront as $970 USD for 12 months or alternatively $97 USD per month for 12 months. The licence is renewable on an annual basis. Cancellation is only applicable after a 12-month cycle and we would require a 28-day notification of this. If no notification is received, the license will automatically renew as to keep a continuation in benefits. This will renew on a month to month basis from year 2 onwards.

In the event of any default in payment for membership fees, due on a recurring basis for Genius Entrepreneur Mastermind, the service will be terminated immediately, the membership will be cancelled and you will be liable for the full outstanding amount for the balance of the 12 month period. GeniusU Limited reserves the right to suspend or terminate supply to the client and list the customer with a credit reporting agency.

Default interest pursuant to clause 2 shall be payable on demand and calculated daily from the date the payment was due to the actual date that the payment is made in full.

Any payment the client makes to GeniusU shall first be credited against any default interest accrued pursuant to this clause 2 to the actual date of payment.

Trusted Buyers Club

Please note that the voucher to spend in Trusted Buyers Club is only available for upfront payment of any of our products & not available on any monthly installments product purchases. The voucher needs to be spent in the round that you enter in and cannot be carried forward.

Termination

We may terminate your account:

if you violate our Terms Of Service Policy

if you promote GeniusU Limited’s product/services in a manner that is unethical or inappropriate. This is particularly pertinent to our pricing policy which we take extremely seriously. We do not authorise any promotions which conflict with the ticket price offered by our company; or for any reason, in our sole discretion

No Warranties

WE MAKE NO WARRANTIES TO YOU OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICE GENIUSU LIMITED, ITS SUBCONTRACTORS AND AFFILIATES PROVIDE YOU. WE EXPRESSLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS OF THIS SERVICE FOR A PARTICULAR PURPOSE. We shall not be liable for any damages suffered by you, whether indirect, special, incidental, exemplary, or consequential, including, but not limited to, loss of data or service interruptions, regardless of cause or fault. We are not responsible for your lost profits or for your loss of data or information. If notwithstanding this clause we are held liable to you.

TERMS

You agree:

  1. to use our system in a manner that is ethical and in conformity with community standards;
  2. to respect the privacy of other users (you shall not intentionally seek data or passwords belonging to other users, nor will you modify files or represent yourself as another user unless explicitly authorised to do so by that user);
  3. to respect the legal protection provided by copyright law, trade secret law, or other laws protecting intellectual property;
  4. to accept commercial emails from us. If we learn of a violation or likely violation of our TERMS OF SERVICE, we will attempt to notify you. If you do not take immediate remedial action which is satisfactory to us, or in the event of a serious violation of the TERMS OF SERVICE, we reserve the right to terminate your account immediately. Every effort will be made to inform you prior to account termination, and to re-establish your account upon receiving such representations from you as we deem appropriate in the circumstances.

YOUR SERVICE WILL BE TERMINATED IMMEDIATELY AND WITHOUT WARNING SHOULD YOU USE OUR SYSTEM AS PART OF ANY BULK EMAIL CAMPAIGN. You may also be subject to fines and legal actions as a result of your bulk email promotion.

Assignment

This agreement is personal to you. You may not assign your rights under this agreement without our prior written consent. If you do assign your rights, as would be the case were someone other than you to use your account, you shall remain liable to us for any fees due under this agreement. We may re-assign or cancel this agreement at any time.

Change of Terms and Conditions

We reserve the right to change the terms and conditions of this agreement as needed. Use of our servers by you after said changes constitutes acceptance of those new terms and conditions. If you do not agree to the new terms and conditions, you may terminate this agreement in accordance with Section B.

Notification of Account Changes

You agree to provide us with such other information relating to your use of this service as we deem necessary or desirable. You agree to notify us if your address, email address, telephone number or billing information changes.

Notices

All notices, requests, demands, and other communications under this agreement shall be in writing and shall be deemed to have been given on the date of delivery: if delivered personally to the party to whom notice is to be given; if sent by electronic mail with a cc: to sender; if sent by fax; or on the third day after mailing by first class mail.

General Provisions

The subject headings of the articles and sections are for convenience only, and shall not affect the construction or interpretation of any of its provisions. If any portion of this agreement is found invalid or unenforceable, that portion shall be severed and the remainder of this agreement shall remain in force. This agreement constitutes the entire agreement between us pertaining to its subject matter and supersedes all of our prior agreements, representations, and understandings. Subject to Section I, no supplement, modification, or amendment of this agreement shall be binding unless executed in writing by both parties. No waiver of any of the provisions of this agreement shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by the party making the waiver. This agreement may be executed in one or more counterparts. Each shall be deemed an original, but all of which together shall constitute one and the same instrument. If an organization is the subscriber, the individual signing up for our services represents that he or she is duly authorised to enter into this agreement on behalf of that organization. In the event of a dispute, the parties agree to submit the matter to the Community Dispute Resolution Service or any recognised Arbitration Board located within our state and county, before instituting litigation.

Complaints handling

If you are concerned that the way in which we have dealt with your personal information involves a potential breach of the Privacy Act, you may contact us using the details above, providing us with details in writing of your complaint. We will investigate such a complaint promptly and will contact you for further information if required.

All complaints should be made in writing detailing relevant information pertaining to the complaint and the parties involved in the alleged breach.
